1. General Provisions

These Terms and Conditions ("Terms") govern the use of the online platform operated at bhpbd.com ("Platform") by BHP Affairs Sp. z o.o., with its registered office at plac Wolności 6/108, 61-738 Poznań, Poland, entered in the National Court Register (KRS) under number 0001207474, NIP: 7831942406, REGON: 54333113300000 ("Company", "we", "us").

By registering an account, purchasing a course, or using the Platform in any way, you ("User", "Student", "you") agree to be bound by these Terms. If you do not agree, please do not use the Platform.

2. Definitions

  • Platform — the website at bhpbd.com and all its subpages, including the learning management system.
  • Course — an online BHP (Occupational Health & Safety) training programme available on the Platform.
  • Certificate — a document issued upon successful completion of a Course and passing the final exam.
  • Account — a personal user profile created upon registration.
  • Order — a binding purchase of a Course through the Platform.

3. Account Registration

3.1. To access Courses, you must create an Account by providing your first name, last name, company name, and a valid email address.

3.2. You may also register using your Google account. In such case, your email is automatically verified.

3.3. You are responsible for maintaining the confidentiality of your login credentials. You must not share your Account with third parties.

3.4. Each Account is personal and non-transferable. The Company reserves the right to suspend or terminate Accounts used in violation of these Terms.

3.5. All new registrations are assigned the "student" role. Access to instructor or administrative features requires separate authorisation by the Company.

4. Services and Courses

4.1. The Platform offers online BHP training courses compliant with the Polish Labour Code (Kodeks pracy), in particular Articles 2373–2375, and the Regulation of the Minister of Economy and Labour of 27 July 2004 on occupational health and safety training.

4.2. Courses are available in multiple languages, including Polish, English, and Bangla.

4.3. Course content, structure, and availability may change without prior notice. The Company strives to keep all materials accurate and up to date.

4.4. Upon successful completion of a Course (including passing the final exam with a minimum score of 70%), the Student receives a Certificate.

5. Orders and Payment

5.1. Prices are displayed in Polish Zloty (PLN) and include VAT (23%) unless stated otherwise.

5.2. Payment is processed through third-party payment gateways (Stripe, PayPal, and other providers). The Company does not store credit card details.

5.3. Upon successful payment, the Student receives immediate access to the purchased Course.

5.4. The Company issues VAT invoices upon request. Invoices are available in the Student's Account under "Purchase History".

5.5. Free Courses may be enrolled in without payment. The same Terms apply to free and paid Courses unless stated otherwise.

6. Right of Withdrawal

6.1. In accordance with the Polish Consumer Rights Act of 30 May 2014 (Ustawa o prawach konsumenta) and Directive 2011/83/EU, consumers have the right to withdraw from a distance contract within 14 days without giving any reason.

6.2. The right of withdrawal does not apply to digital content (Courses) if the performance has begun with the consumer's prior express consent and acknowledgement that the right of withdrawal is thereby lost (Art. 38 point 13 of the Consumer Rights Act).

6.3. By starting a Course (accessing course materials or taking the exam), you expressly consent to the immediate performance of the contract and acknowledge the loss of the right of withdrawal.

7. Intellectual Property

7.1. All content on the Platform — including course materials, videos, texts, graphics, logos, and software — is the property of BHP Affairs Sp. z o.o. or its licensors and is protected by Polish and international copyright law.

7.2. Purchasing a Course grants you a personal, non-transferable, non-exclusive licence to access and use the course materials for your own educational purposes only.

7.3. You may not copy, distribute, modify, publicly display, or commercially exploit any content from the Platform without prior written consent from the Company.

8. Student Obligations

8.1. You agree to use the Platform solely for lawful purposes and in compliance with these Terms.

8.2. You must not:

  • Share your Account credentials or allow others to use your Account.
  • Attempt to bypass technical security measures.
  • Record, screenshot, or redistribute course content.
  • Use automated tools (bots, scrapers) to access the Platform.
  • Submit false information during registration or exams.
  • Take exams on behalf of another person.

8.3. Violations may result in immediate Account termination without refund.

9. Certificates

9.1. Certificates are issued electronically and can be downloaded from the Student's Account.

9.2. Each Certificate contains a unique verification number. Certificate authenticity can be verified on the Platform.

9.3. Certificates confirm completion of training in accordance with Polish BHP regulations. The Company does not guarantee that a Certificate will be accepted by all employers or authorities — acceptance depends on the specific requirements of the employer and applicable regulations.

10. Limitation of Liability

10.1. The Company provides Courses for educational purposes. Course content does not constitute legal, medical, or professional advice.

10.2. The Company is not liable for any indirect, incidental, or consequential damages arising from the use of the Platform or reliance on course content.

10.3. The Company does not guarantee uninterrupted access to the Platform. Temporary outages may occur for maintenance or technical reasons.

10.4. The total liability of the Company to any User shall not exceed the amount paid by that User for the Course in question.

11. Data Protection

11.1. Personal data is processed in accordance with the General Data Protection Regulation (GDPR/RODO) and the Polish Act on Personal Data Protection of 10 May 2018.

12. Complaints

12.1. Complaints regarding the Platform or Courses may be submitted by email to: [email protected].

12.2. Complaints will be processed within 14 days of receipt.

12.3. Consumers may use the EU Online Dispute Resolution platform at: https://ec.europa.eu/consumers/odr.

13. Amendments

13.1. The Company reserves the right to modify these Terms at any time. Changes take effect upon publication on the Platform.

13.2. Registered Users will be notified of significant changes by email. Continued use of the Platform after notification constitutes acceptance of the updated Terms.

14. Governing Law and Jurisdiction

14.1. These Terms are governed by the laws of the Republic of Poland.

14.2. Any disputes shall be resolved by the competent courts in Poznań, Poland, unless mandatory consumer protection laws require otherwise.
